Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not furnish employment and a place of employment which were
free from recognized hazards that were causing or likely to cause death
or serious physical harm to employees in that employees were exposed to:
a) Confined space entry program was not followed to protect employees
who are exposed to atmpsoheres which are potentially deficient in
oxygen and which are in excess of acceptable personal exposure limits
of toxic contaminants. ANSI 2117.1-1982. American National Standard
Safety Requirments for working in tanks and other confined spaces and
other OSHA standard 1910.146 "Confined Space Entry" which contains
accepted requirements that include: training personnel, testing the
atmosphere, ventilation of the confined space, standby people in
constant communication with those inside a confined space,
respiratory protection, permit system authorizing approval for all
work and appropriate protective measures that are to be provided.
