Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to falls of 16 feet from an elevated platform: a)Sunny Wholesale (Warehouse): Warehouse employees are at risk of falling up to 16 feet to the concrete floor of the warehouse while being lifted by the Yang Forklift while standing on either a single pallet or a five foot stack of pallets. Note: Among other feasible and acceptable abatement methods would be to: 1.Construct the elevating platform in accordance with ANSI B56.1-1988, Section 7.34.1.1 which requires a slip resistant surface and Section 7.34.1.3, or equivalent which requires restraining means positioned at a vertical height not less than 36 inches nor more than 42 inches. 2.Provide a scaffold or solid construction. 3.Provide a ladder.de
