Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to:
a)Employer did not furnish employment and a place of employment which were
free from
recognized hazards that were causing or likely to cause death or serious
physical harm
to employees. Employees were exposed to the hazard of being beneath
shipping container
doors while the locking mechanism was disengaged. On or about January 15,
2005, two
employees were preparing to unload corrugated paper rolls (weighing
approximately
2,030 lbs. apiece) from the rear of a 40-foot container that have been
transported to the
unloading site on an 18-wheeler chassis. One of the employees stood on a
metal step
attached to the chassis and disengaged locking mechanism on one of the
container doors,
whereupon the door flew open and a paper roll fell on the employee,
crushing him.
Feasible means of abatement include, but not limited to: Unload freight on
a loading
dock level with desk of the container, secure container doors with chains
so that they will
not fly open unexpectedly. Establish and implement safe work procedures
for the
unloading of all freight from delivery vehicles. Train employees in the
safe unloading of
freight that may have shifted during shipment.
