Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: Employee exposed to approximately 20 ft. 3 inch fall to concrete sidewalk, standing on 1 ft. wide balcony parapet, washing windows with extension pole set at approximately 35 ft. and without fall protection system. Among other methods, feasible and acceptable methods to correct this hazard are, but not limited to: 1. Train employees and supervisors in the recognition and avoidance of hazards associated with window cleaning based upon building configuration weather and other conditions, and 2. Enforce the use of fall protection equipment through a fall and consistent progressive discipline program, and 3. Provide and use fall protection systems such as controlled descent systems, i.e. boatswain's chairs or swing stage scaffolds with safety belts, lanyards, and independent life lines, and 4. Provide and use mobile scaffolds, powered platforms, powered scaffolds, or aerial lifts, or 5. Provide and use safety belts with lanyards and life lines.
