Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not furnish
employment and a place of employment which were free from recognized
hazards that were
causing or likely to cause death or serious physical harm to employees in
that employees were
exposed to fall hazards while using the top step of a step ladder.
(a)On or about October 17, 2002 at the jobsite located at Oscars
Frozen Custard, 2362 S. 108th Street, West Allis, WI, a worker
who was washing windows on the west elevation was standing on
the top rung of a five foot aluminum Werner Ladder, and was
exposed to injuries from a potential fall.
A feasible means of abatement among others, would be to comply
with American National Standard Institute (ANSI) A14.5 1992
American National Standard Ladders; Portable Reinforced Plastic,
Safety Requirements which prohibits users from standing on the
top step of a step ladder.
No certification required.  Violation abated.
