Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to THE HAZARD OF FALLING:
a)Wegmans Tent Sale area, on or about 8/9/02:  Employee exposed to a fall
hazard of approximately 9 feet while standing on an unsecured wooden pallet
elevated by a Mitzubishi forklift.  A restraining means such as a guardrail
system or a means for securing personnel such as a body belt and lanyard,
was not provided.
Among other methods, one feasible and acceptable abatement method to
correct this hazard is to:  1) Utilize a safety platform which meets the
requirements of ANSI ASME B56.1 - 1993 Safety Standard for Low Lift and
High Lift Trucks, paragraph 7.35 for platforms used for elevating
personnel.
2) Instruct and train employees in the proper use of forklifts including
the
use of platforms for elevating personnel.
