Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of being struck by an excavator: (a)Ironwood Subdivision, employees operating three excavators to excavate coral soil. Nuts, bolts and/or rebar were used as pins to secure the bucket to the excavator instead of the pins originally provided by the manufacturer to secure the bucket. The equipment is as follows: 1.SamSong Excavator MX 292. 2.Hyundai Rolex 210 LC-3 Excavator. 3.Daewoo 220 LC-III Excavator. Among other methods, one feasible and acceptable method to correct the hazards is: A.) To follow the association of Equipment Manufacturer's (AEM) "Safety Manual for Operating and Maintenance Personnel" which requires that damaged and missing parts were repaired or replaced, B.) To follow the Association of Equipment Manufacturer's Operator Manual by using only service parts meeting manufacturer specifications, and C.) To train operators and maintenance personnel to inspect equipment for defects and to complete service and repairs before equipment was placed back into service. THE SEONG JIN CONSTRUCTION, INC. WAS PREVIOUSLY CITED FOR A VIOLATION OF THIS OCCUPATIONAL SAFETY AND HEALTH STANDARD OR ITS EQUIVALENT STANDARD SECTION 5(A)(1) OF THE OCCUPATIONAL SAFETY AND HEALTH ACT OF 1970 WHICH WAS CONTAINED IN OSHA INSPECTION NUMBER 308578921, CITATION NUMBER 1, ITEM NUMBER 1, ISSUED ON JUNE 15, 2005, WITH RESPECT AT A WORKPLACE LOCATED AT THE UNIVERSITY OF GUAM, MANGILAO, GUAM. THE SEONG JIN CONSTRUCTION, INC. WAS PREVIOUSLY CITED FOR A VIOLATION OF THIS OCCUPATIONAL SAFETY AND HEALTH STANDARD OR ITS EQUIVALENT STANDARD SECTION 5(A)(1) OF THE OCCUPATIONAL SAFETY AND HEALTH ACT OF 1970 WHICH WAS CONTAINED IN OSHA INSPECTION NUMBER 113614408, CITATION NUMBER 1, ITEM NUMBER 1, ISSUED ON OCTOBER 11, 2005, WITH RESPECT TO A WORKPLACE LOCATED AT THE UNIVERSITY OF GUAM, MANGILAO, GUAM.
