P.L. 91-596 Section 5(a)(1) of the Occupational Safety and Health Act of %% 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard(s) of defective material handling equipment accessories: (a)Woodyard - The Model 988B CATERPILLAR front-end loader (Serial Number 50W11047) had a shattered left side view mirror, inoperable wipers, an inoperable air conditioning unit, and the left access ladder at the rear had a detached lower rung, on or about 4/7/94. Among other methods, one feasible and acceptable abatement method to correct his hazard is to maintain equipment promptly when defects are detected and reported by the operator(s).

P.L. 91-596 Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazards of hot surfaces, gasoline fueling, gasoline vapors and engine exhaust and unguarded power transmission equipment: (a)Workplace - The three-wheel "RED RIDER" motorized utility carts used to transport employees and equipment had the gasoline engines in an unenclosed area at the front wheel by the handle bar steering assembly. The fuel tank, with a vented cap, was at the top of the engine next to the unprotected, uncovered exhaust pipe and the muffler (which was also in front of the operator and passenger area). The power transmission equipment (including v-belts, pulleys, chain and sprocket(s)) was not guarded and located in front of the operator and passenger area, on or about 4/7/94. Among other methods, some feasible and acceptable abatement method to correct this hazard are: 1.Pipe engine exhaust gases in a direction away from the operator and passenger area. 2.Guard or insulate exhaust piping in areas where contact by employee(s) is possible. 3.Move the gasoline fuel tank to a protected area to the rear of the operator and passenger area. 4.Provide a fuel tank filler pipe located in such a position or protected in such a manner as to not allow spill(s) or overflow to run onto the engine, exhaust or electrical equipment. 5.Enclose the engine, including hot surfaces, belts, pulleys, chains and sprockets, or other reciprocating, rotating, or other moving parts or equipment.
