Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not furnish employment
and a place of employment which were free from recognized hazards that
were causing or likely to cause
death or serious physical harm to employees, in that:
(a)SEA WALL CONSTRUCTION AT ASILI, AMERICAN SAMOA: ON OCTOBER 13, 2006,
operator of a CAT excavator was operating the equipment to move large
rocks and dirt to fill up the
side of the road for a retaining wall. Regular rebars were modified as
pins to secure the bucket or
shovel to the excavator instead of the pins originally provided by the
manufacturer. Slippage of the
coupling could result in unintended separation of the bucket during
operation or maintenance,
potentially striking or injuring an employee.
AMONG OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE METHOD TO CORRECT
THE HAZARD IS:
1.To follow the Association of Equipment Manufacturers (AEM) "Safety
Manual Operating and
Maintenance Personnel" which requires that damaged and missing parts are
repaired,
and
2.To follow the Manufacturer's Operator Manual by using only service parts
meeting
manufacturer specifications, and
3.To train the operators and maintenance personnel to inspect equipment
for defects and
complete service repairs before equipment is placed back in service.
