29 CFR 1926.28(a): The employer did not require the wearing of appropriate personal protective equipment in all operations where there is an exposure to hazardous conditions. (a) At the work site located behind the prison, an employee was walking around a 2000 International dump truck, License Number C-415, without the use of foot protection therby, exposed to struck-by and/or crush hazards that may potentially result in broken toes.

29 CFR 1926.601(b)(4): The employer had in use motor vehicle equipment having an obstructed view to the rear which did not have a reverse signal alarm audible above the surrounding noise level or an observer signaling it was safe to back up the vehicle. (a) At the worksite located behind the prison, a 2000, International Dump Truck, License Number C-415, was backing up with the end dump in the raised position without audible reverse warning alarms or the use of a flagman thereby exposing personnel on the ground to potential struck-by hazards from falling rock material and/or equipment.
