Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not furnish employment and a place of employment which
were free from recognized hazards that were causing or likely to cause
death or serious physical harm to employees in that employees were
exposed to potential toxic atmospheric conditions including but not
limited to oxygen deficiency:
Tank cleaning, tanks 1 and 2 - Employees entering railroad tank
cars (confined spaces) containing products including but not
limited to caustic soda, chlorine, sulfur, sulfuric acids and
pickle liquor without an attendant/standby person stationed at the
tank car entrance to assist the employee(s) in case of emergency,
on or about 5/7/91.
Among other methods, one feasible and acceptable abatement method
to correct this hazard is to have an attendant/standby person
stationed at tank cars being cleaned and ensure that attendant
remains outside the permit space at all times during entry
operations.
Attendants are to receive the appropriate training and perform
their assigned duties under the entry permit program.
