P.L. 91-596 Section 5(a)(1) of the Occupational Safety and Health Act of
1970: The employer
did not furnish employment and a place of employment which were free from
recognized hazards
that were causing or likely to cause death or serious physical harm to
employees in that
employees were exposed to the hazard(s) of been thrown out and crushed by
a forklift truck or
a "mule"in the event of a tip-over:
a) Throughout the plant - employees were not wearing seat belts or an
"operator restrain system"
while operating forklift trucks and "mules", on or about 11/10/99.
Among other methods, one feasible and acceptable abatement method to
correct this hazard is
to:
1. Equip all forklift trucks and mules with operational seat belts and
enforce their use while
operating the equipment.
For assistance refer to ANSI B56.1-1989 or later revision and manufacturer
recommendations.
