Section 5(a)(1) of the Occupational Safety and Health Act of 1970: the employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of falls from elevations: a) West wall, employees working on the building curtain wall in excess of 30 feet above ground level, were not protected by safety belts, lanyards and lifelines, on or about 9/10/91. b) West wall, an employee walking on the building curtain wall, at a height in excess of 40 feet above ground level, was not protected from a fall by the use of a safety belt, lanyard, lifeline or equivalent type of fall protection, on or about 11/15/91. Among other methods, one feasible and acceptable abatement method to correct this fall hazard is to require and enforce the use of safety belts, lanyards and lifelines or an equivalent type of fall protection.
