The following item as described in the Citation issued on 1/24/92 is
amended as follows:
Citation 01, Item 001, standard changed.
Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not furnish employment and a place of employment which were
free from recognized hazards that were causing or likely to cause death or
serious physical harm to employees in that employees were exposed to:
a)  On 1/8/92, Job Site
Employees working in excavations were exposed to unsafe
conditions.
Among other methods to instruct each employee in the recognition
and avoidance of unsafe conditions and regulations applicable
to his work environment to control or eliminate any hazards or
other exposure to illness or injury.
Both the amended citation and the original citation must remain posted for  3
working days.
The employer has 15 working days from the date of receipt of the amended
citation to contest those portions of the original citation which have been
amended.  The contest period is not extended for the unamended portions of
the original notification.

employer did not furnish employment and a place of employment which were
free from recognized hazards that were causing or likely to cause death or
serious physical harm to employees in that employees were exposed to:
a)  On 1/8/92, Elizabeth Ann Section, Range 50, Grave 157, East Wall
The spoil was at the face of the excavation.  The dimensions of
the excavation are 9 feet deep, 4 feet wide, and 8 feet long.
Among other methods, hazard is to place and maintain excavated
or other materials or equipment at least 2 feet from the edge
of excavations, or by the use of retaining devices that are
sufficient to prevent materials or equipment from falling or
rolling into excavations, or by a combination of both if
necessary.

Employer did not have a competent person to conduct inspection
of all the excavations daily.  Employees were working in
excavations which were not shored, sheeted or sloped.
Among other methods to conduct daily inspections of excavations,
the adjacent areas, and protective systems by a competent person
prior to the start of work and as needed throughout the shift.

serious physical harm to employees in that employees were exposed to:
a)  On 1/8/92, Mathew Section
Employees were working in an excavation without sheeting, shoring
or sloping.  The dimensions are 9'3" deep, 10'3" wide and 25'
long.
b)  On 1/8/92, Elizabeth Ann Section, Range 50, Grave 157
Employees were working in an excavation without sheeting, shoring
or sloping.  The dimensions are 9' deep, 4' wide, and 8' long.
c)  On 1/8/92, Elizabeth Ann Section, Range 29, Grave 150
Employees were working in an excavation without sheeting, shoring
or sloping.  The dimensions are 7'10" deep, 3' wide and 8' long.
Among other methods to correct this hazard is to protect employees
in a excavation from cave-ins by providing an adequate protective
system designed in accordance with 29 CFR 1926.652 (b) or (c).
Both the amended citation and the original citation must remain posted
for 3 working days.
The employer has 15 days from the date of receipt of the amended citation
to contest those portions of the original citation which have been amended.
The contest period is not extended for the unamended portions of the origin -
al notification.
