Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of being crushed or asphyxiated by a cave in. The employer failed to sheet, shore or slope the excavation: (a) On 1/22/92, At the Mathew Section Employees were observed removing wood and metal separations between coffins in an unprotected excavation (grave) approximately 10 ft. deep X 10 ft. wide X 20 ft. long. Among other methods, one feasible and acceptable abatement method to correct this hazard is to provide each employee in an excavation with protection from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652 (b) or (c).
