Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not furnish employment and a place of employment which were
free from recognized hazards that were causing or likely to cause death
or serious physical harm to employees in that employees were exposed to
the hazard of being crushed as a result of overloading the crane because
of a lack of training in the operation of a mobile crane.
One feasible and accepted abatement method to correct this hazard is a
more thorough training program for cranes which would include load
rating charts and hands-on type of training. This hazard is recognized
by ANSI ASM-B-30.5-1982 Section 5.31.1 and 5.31.2:
