Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The %% employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a) A knot bumper was working near a Caterpillar Model 225 loader that was not provided with a safeguard to prevent employees from entering the pinch point created by the frame and the swinging superstructure of the machine on the Vantage Sale Landing, B-260 Road, Warm Springs, Oregon. Among other methods, one feasible and acceptable abatement method to correct this hazard is to provide a barrier consisting of a light weight metal frame which can be pulled up and out of the way while traveling. Johnnie Guerin Logging was previously cited for a violation of this Occupational Safety and Health Standard or its equivalent (Section 5(a)(1) which was contained in OSHA Inspection Number 103195988, Citation Number 1, Item Number 1, issued on July 17, 1987.
