Section 5(a)(1) of the Occupational Safety and Health Act of 1970:
The employer did not furnish employment and a place of employment
which were free from recognized hazards that were causing or likely
to cause death or serious physical harm to employees in that
employees were exposed to:
a) The hazard of being crushed by equipment rollover while
operating the swing boom skidder that was not equipped
with a seatbelt at the Wilson Creek II Sale, Road S594,
Warm Springs, Oregon.
b)The hazard of  being crushed by equipment rollover while
operating the fixed boom skidder that was not equipped
with a seatbelt at the Wilson Creek II Sale, Road S594,
Warm Springs, Oregon.
c)The hazard of being crushed by equipment rollover while
operating the loader that was equipped with a rollover
protective structure and not wearing the seatbelt
provided at the Wilson Creek II Sale, Road S594, Warm
Springs, Oregon.
Among other methods one feasible and acceptable abatement method to
correct these hazards is to install and use seatbelts on the
skidders and the loader.
