Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The

employer did not furnish employment and a place of employment which
were free from recognized hazards that were causing or likely to cause
death or serious physical harm to employees in that employees in a)
Section 2700 respiratory isolation rooms, b)  The Pulmonary
(Bronchoscopy) Room and c)  The Respiratory Therapy Department, were
exposed to the hazard of being infected by tuberculosis through
repeated
prolonged indoor contact with patients who may be infected with
tuberculosis in that:
Negative pressure respiratory isolation rooms were not available when
such patients were undergoing bronchoscopy, sputum induction,
aerosolized pentamidine treatments or suction procedures.
Feasible and usefull abatement methods for reducing this hazard as
recommended by the Center for Disease Control are:
Respiratory isolation rooms, under negative pressure, exhausted
to the outside, shall be provided when patients with, or suspected
to have, active tuberculosis are present in:
a)  Section 2700, respiratory isolation rooms;
b)  The pulmonary; "Bronchoscopy" Room used for the
administration of bronchoscopy and other high risk procedures;
c)  Respiratory Therapy Department - treatment rooms.
