Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: (a) Boiler area 9th floor - On or about April 6, 1995, an employee was exposed to the hazards of being struck by a chain fall hoist rigging system when lifting up a bank of boiler tubes of unknown capacity, using a hoist not equipped with a device to prevent over load. Among other method's one feasible and acceptable abatement method to correct this hazard is to enforce existing safety rules emphasized in the safety rule book and manufactures safe operating procedures for chain fall hoist rigging systems and add specific rigging procedures in work requests.
