Section 5(a)(1) of the Occupational Safety and Health Act of 1970: %% The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to an in-house shipping trailer which had a variety of hazardous conditions: (a) On-site at J & L, Midland, PA; The in-house shipping trialer had the following deficiencies: 1. The flooring boards of the flat bed were either rotting or mossing; 2. Tires were excessively worn or bald; and 3. The frame of the trailer was cracked.
