Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: A section of the conveyor system was placed in an upright position for measurement and review purposes. The section of conveyor was not restrained, blocked, cribbed, or otherwise secured to prevent the section of conveyor to fall from a position of rest. On or about February 27, 1996 an employee was killed when the unrestrained section of the conveyor fell, pinning the employee between the underside of the conveyor and the floor. or in the alternative: 29 CFR 1910.147(d): The established procedure for the application of energy control (the lockout or tagout procedures) did not cover the following elements, actions and done in sequence as required by 29 CFR 1910.147(d)(1)-(d)(6): At the plant, in the feed mill: the application of controlling energy did not include turning the equipment off, isolation of the 440 volt electrics and air systems, applying lockout devices, relieving stored energy, including the blocking if the conveyor with stands when in an up position; to safeguard against the hazard of potential collapse, and the verification of isolation, during inspection work, where the vertical control gear box was removed and an employee was under the #4 packer, sewing machine, scales, and flow belt.
