Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer does not furnish employment and a place of employment which are free from the recognized hazards of falling that are causing or likely to cause death or serious physical harm to employees: This violation was observed on or about February 15, 2011 at the railcar siding adjacent to the flour warehouse, where employees were exposed to falls of approximately 15 ft. while sampling grain and obtaining seal numbers from the top of railcars. Among other feasible methods to correct the hazard, one method would be to install a permanent horizontal lifeline system with retractable lifeline along the railcar siding area. Pursuant to 29 C.F.R 1903.19, within 10 (ten) calendar days of the abatement date, the employer must submit documentation describing the actions it is taking to establish, communicate, and implement written procedures to ensure that employees have fall protection while performing work from the top of the rail cars.

Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of being struck by the breaker bar when attempting to open the railcar hopper gates: This violation occurred on or about December 7, 2010, at the rail car siding, where employees were exposed to being struck by the breaker bar if it slipped while attempting to open railcar hopper gates. Among other feasible methods to correct the identified hazard, one method would be to acquire a tool specifically designed to safely open the railcar hopper doors. Pursuant to 29 C.F.R. 1903.19, within 10 (ten) calendar days of the abatement date, the employer must submit documentation describing the actions it is taking to ensure employees are using safe tools to open railcar hopper gates.
