Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to an injury from unintended actuation of a foot pedal not protected by a guard: (a)Plant - Employees operate the Stokes & Smith Company miter machines, no serial number available, to cut the corners of paper sheets for boxes. No means was provided to protect the foot pedal from unintended activation by falling or moving objects or by someone accidently stepping on it. (b)Plant - Employees operate the M.D. Knowlton Company corner cutting machines, no serial number available, to cut the corners of cardboard for boxes. No means was provided to protected the foot pedal from unintended activation by falling or moving objects or by someone accidently stepping on it. (c)Plant - Employees operate the M.D. Knowlton Company hand stayer machine to tape the corners of cardboard for making boxes. No means was provided to protect the foot pedal from unintended activation by falling or moving objects or by someone accidently stepping on it. Among other methods, one feasible and acceptable abatement method to correct this hazard is to guard the foot pedals/treadle. OR IN THE ALTERNATIVE 29 CFR 1910.212(a)(1): Machine guarding was not provided to protect operator(s) and other employees from hazard(s) created by unintended activation of a foot pedal. (a)Plant - Employees operate the Stokes & Smith Company miter machines, no serial number available, to cut the corners of paper sheets for boxes. No means was provided to protect the foot pedal from unintended activation by falling or moving objects or by someone accidently stepping on it. (b)Plant - Employees operate the M.D. Knowlton Company corner cutting machines, no serial number available, to cut the corners of cardboard for boxes. No means was provided to protected the foot pedal from unintended activation by falling or moving objects or by someone accidently stepping on it.
