Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to an injury from unintended actuation of a foot pedal/treadle not provided with a guard. (a)Miter Machine Area - Samuel Parry miter machine number 3, serial number 744, had no means provided to protect the foot pedal from unintended activation by falling or moving objects or by someone accidently stepping on it. AMONG OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE ABATEMENT METHOD TO CORRECT THIS HAZARD IS TO INSTALL A FOOT PEDAL/TREADLE GUARD.
