Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to:
a)The hazard of entering the Effluent Structure a thirty-six feet deep,
twenty feet diameter
enclosed tank at New Bedford Waste Water Treatment Facility, where there
was the
potential for a hazardous atmosphere.
Among other methods, one feasible and acceptable abatement to correct this
hazard is to enforce
an adequate Confined Space Entry Procedures meeting the stipulations of
Dick corporations
confined space entry program and/or  NIOSH Criteria Document No. 80-106,
December 1979
and/or ANSI Z117-1989 safety requirements for confined spaces.
Elements of a confined space entry program which were not implemented when
the
Effluent
Structured was entered include but are not limited to:
1)Implementing a permit system to certify that all existing hazards have
been evaluated and
necessary protective measures have been taken.
2)Atmospheric testing for oxygen deficiency, flammability, and toxic
materials.
3)Providing quick and safe rescue of employees inside the confined space
by the
availability of safety equipment such as harness and lifeline.
4)Labeling the entrance to the confined space to ensure entry by permit
only.
