Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm in that employees in the warehouse and dock areas were exposed to the hazard of falling from an orange pallet marked"U.S.Postage" which rested in an unsecured fashion on top of the forklift lifting forks. Among other methods, one feasible and acceptable method to correct this hazard is to utilize a lifting platform built with a positive means of being secured to the lifting carriage or forks. For guidance refer to American National Standards Institute, B56.1-l993, Section 7.35.3.
