Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of explosion and exposure to an atmosphere immediately dangerous to life and health from a pressurized liquid ammonia storage tank which was not constructed according to the applicable provisions of the ASME Boiler and Pressure Vessel Code or other equally protective standard and/or was not certified by an approved testing laboratory or other governing body for the purpose in which it was used. Such tank was located in the northern portion of the facility next to the maintenance shop.

Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of explosion and exposure to an atmosphere immediately dangerous to life and health from a pressurized liquid ammonia receiver vessel which was not equipped with a safety relief valve or other device designed to prevent pressure within the vessel from rising above a safe limit in the event of failure of operating controls or exposure to excessive heat. Such receiver vessel was an integral part of the ammonia refrigeration system used at the plant and was located in the northern portion of the facility next to the maintenance shop. A feasible abatement for this condition would be to vent the safety relief valve to an outdoor or other location away from employee work areas and in compliance with state and other municipal regulations.
