Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: (a) Crushing injuries by the collapse of the first floor of the storage area on or about March 5, 1991. The lower story of the dyehouse is a concrete framed structure with cast-in-place concrete columns, beams, and slab, structural members of a 33' x 66' section approximately (8 bays) of the first floor slabs - exposed bottom bars in both directions; concrete severely spalled and flexural bars do not have any bond with the concrete; pieces of concrete have been separated from the slab and are ready to fall; extensive rusting in all exposed bars; deep and wide cracks exist in all directions. Beams - show signs of distress: main longitudinal bars are exposed and few have no bond with the concrete; exposed shear stirrups; diagonal cracks at both ends of beams; deep and wide cracks in both faces of beams running for their entire length; pieces of concrete have separated from the beams and are ready to fall. Columns - exposed rebars; deep and wide cracks; concrete severely spalled. Among other methods, one feasible and acceptable abatement method to correct this hazard should include and may not be limited to the following area: A thorough assessment of the dyehouse storage area by a registered professional engineer (PE) knowledgeable and competent in structural engineering: Conduct demolition operations in accordance with subpart T. "Demolition," of the OSHA construction standards, which includes in part requirements for shoring or bracing of damaged and adjacent areas as determined by the engineering survey. Comply with other applicable OSHA standards as appropriate; and replace the slab, beams and columns bay by bay.
