Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazards of being crushed by an overturning crane: a.At the Otter Creek jobsite, employees were exposed to the hazards of a tippinf condition while tracking a Link-Belt model LS-98 crane back and forth over timber mats used as a work platform. On or about May 21, 1994, an employee was fatally injured when one of the crosswise timber mats used as a work platform moved forward while the crane was tracking over the mats with a sheet piling and vibratory hammer load of 7,000 pounds causing the crane to overturn. The crane could not distribute its load properly because a stump and a hole in the ground forced the employer to space two 4 feet x 20 feet timber mats four feet apart. One feasible and acceptable method, among others, to correct this hazard is to construct a firm footing by making sure the ground throughout the work area is uniformly level, and, install the proper number of timber mats close together so that the structural members can sufficiently distribute the load, as specified in American National Standard Institute ANSI B30.5-1968 Crawler, Locomotive and Truck Cranes.ive
