Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: (a) The collapse of the free-standing steel stack on or about March 7, 1991, at the Golden Aluminum Company plant site at 14555 Old Curpus Christi Road, San Antonio, Texas. The inferior field welds failed between the bottom and middle sections of the steel stack. Among other methods, one feasible and acceptable abatement method to correct these hazard(s) is to ensure that employees assigned to perform welding are qualified, trained and properly instructed.

Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: (a) The collapse of a free-standing steel stack at the Golden Aluminum Company plant site at 14555 Old Corpus Christie Road, San Antonio, on or about March 7, 1991. The employer failed to ensure the integrity of the field welds by adequate inspections and non-destructive testing of the welds by recongized methods, such as ultrasonic, radiographic testing, etc. Amont other methods, one feasible and acceptable abatement method to correct this hazard is to conduct inspections and testing to ensure the integrity of the field welds.
