Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: (a) On or about July 18, 1991, employees were exposed to the hazard of falling approximately 22 feet to the ground below while walking on the steel roof joists and while welding steel roofing without fall protection at the K-Mart Store construction site, Devils Lake, North Dakota. Among other methods, feasible and acceptable abatement methods to correct this hazard would include, but not be limited to, the use of safety belts and lanyards or provide scaffolding or work platforms with guardrails.
