1926.21(b)(2) The employer did not instruct each employee in the recognition and avoidance of unsafe conditions to control or eliminate any hazards: a)Metro Construction, Inc. at Highway 11 & 57th Street, Sioux Falls, SD 57110: On or about and at times prior to April 18, 2023, the exposing employer did not ensure that employees were protected from cave-in hazards while conducting work within an excavation by an adequate protective system. This condition exposed employees to cave-in and struck-by hazards associated with trench wall cave-in. Metro Construction, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.652(a)(1), which was contained in OSHA inspection number 1593789, citation number 1, item number 1, and was affirmed as a final order on July 15, 2022, with respect to a workplace located at 41st Street and Terry Avenue, Sioux Falls, SD 57106. Metro Construction, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.652(a)(1), which was contained in OSHA inspection number 1487169, citation number 1, item number 1 and was affirmed as a final order on December 15, 2020, with respect to a workplace located at the Intersection of 271st Street and Louis Avenue in Sioux Falls, SD 57106.
