Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to falls of 12 feet: a)Meitetsu Mart: On 04/09/02 an employee standing on an unsecured wood pallet without standard guardrails was raised twelve (12) feet above the concrete ground by a Toyota forklift vehicle(CNMI vehicle license HE 1422) in order to change light bulbs in the Meitetsu Mart sign. The employee was not provided with a safety cage or other safe means of being lifted or elevated. Note: Among other feasible and acceptable abatement methods would be to: 1.Provide a "safety platform" used in accordance with ANSI B 56.1 1975, Part III-Section 513, or equivalent protection. 2.Provided a scaffold or solid construction from which to change the sign light bulbs. 3.Provide a ladder.
