Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a)Apache Gold Casino: Pavilion Building: When elevating personnel on the high lift forklift, the employer failed to ensure employee(s) are protected with a personal fall arrest system. b)Pavilion Building: When elevating personnel on the high lift forklift, the employer failed to ensure the lifting platform to the lifting carriage and/or the lifting forks to prevent pivoting while the employee(s) are elevated. Abatement Note: AMONG OTHER METHODS ONE FEASIBLE AND ACCEPTABLE ABATEMENT METHOD TO CORRECT THESE HAZARDS TO ENSURE EMPLOYEES ARE NOT ELEVATED ON THE HIGH LIFT FORKLIFT WITHOUT PROVIDING ADEQUATE SAFETY PRECAUTIONS AS REFERENCED IN ITS SDF B56-4.17.2(c) AND B56-4.17.3(c)
