Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were subject to being struck by the rotating super structure of the crawler type backhoe a) Tower Crane #1 - the Caterpillar crawler type backhoe #235, did not have its accessible area within the swing radius of the super structure guarded, 7/17/85. A feasible and useful means of abatement would be to install barriers or to rope off the area adjacent to the super structure.
