Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to an injury from an unintended actuation of a foot pedal not protected by a guard: (a)Brake Area - No means were provided to protect the two (2) foot pedals of the Chicago Dreis & Krump mechanical press brake from unintentional actuation by falling or moving objects or by someone accidently stepping on it, on or about November 12, 2002.
