Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employmnent and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to vehicular traffic:
(a)  901 West 12th Street, Erie, PA; an employee was throwing discarded
bricks
into the rear of a truck while standing in the slow lane of West 12th
Street.
Traffic cones were used to divert traffic from the area, but the employee
was not
wearing any high-visibility clothing.  On or about December 6, 2006.
AMONG OTHER METHODS, ONE FEASIBLE AND USEFUL METHOD TO ABATE THIS
HAZARD WOULD BE TO REFER TO THE "MANUAL OF UNIFORM TRAFFIC
CONTROL DEVICES-2000, (MUTCD), MILLENNIUM EDITION, SECTION 6D.02.2,
WORKER CONSIDERATION, AND SECTION 6E.02, HIGH VISIBILITY CLOTHING;
which reads as follows:
Section 6D.02. - Worker Consideraton
2.  Worker Clothing - workers close to the motor vehicle traveled way
should wear bright,
highly visible clothing (see Section 6E.02).
Section 6E-02 High-visibility clothing - For daytime work, the flagger's
vest, shirt, or jacket
shall either be orange, yellow, yellow-green, or a flourescent version of
these colors.  For
nightime work, similar outside garments shall be retroreflective.  The
retroreflective material
shall be either orange, yellow, white, silver, yellow-green, or a
reflective version of these
colors, and shall be visible at a minimum distance of 300 m (1,000 ft.).
The retroreflective
clothing shall be designed to clearly identify the wearer as a person.
