29 CFR 1926.451(f)(6): Scaffolds were erected, used, dismantled, altered, or moved such that they, or any conductive material handled on them, could have come closer than the minimum distances established for specific voltages as set forth in the table in subparagraph (f)(6). a) Tirpak Building Maintenance / 2113 Sassafras Street, Erie, PA: On or about June 6, 2012, employees were working on a swing scaffold to complete pointing and brink work/restoration on the steeple. The swing scaffolding was located approximately 8 feet from an electrical line with approximately 7200 volts. The minimum distance allowed is 10 feet from the power line. b) Tirpak Building Maintenance / 2113 Sassafras Street, Erie, PA: On or about June 6, 2012, employees were working on a swing scaffold within approximately 2.3 feet of an electrical branch line going from the power lines to the church. The electrical branch line was rated at approximately 240 volts. The minimum distance allowed is 3-feet for lines rated 300 volts or less.

29 CFR 1926.501(b)(13): Employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph (b): a) Tirpak Building Maintenance / 2113 Sassafras Street, Erie, PA/Rectory: On or about June 6, 2012 employees were walking across the lower roof to get to the scaffold that was utilized as a means to access the work zone for chimney removal and capping work. Employees were exposed to a fall hazard of approximately 9-1/2-feet while walking across the lower roof. Personnel were not protected from falling from the lower roof to the ground by any fall protection systems.

29 CFR 1926.1053(b)(1): Portable ladders were used for access to an upper landing surface and the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladder was used to gain access: a) Tirpak Building Maintenance / 2113 Sassafras Street, Erie, PA: On or about June 6, 2012 employees were using a ladder that extended less than 1-foot above the roof line. Employees were using the ladder as a means of accessing the work area on the roof. The work being completed included but was not limited to the removal and capping of 2 (two) chimneys.
