Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: (a) On or about May 14th, 1996, at the Unimed Skywalk, Minot, North Dakota, employees were exposed to a potential fall hazard while working on the elevated work platform on the forklift. The work platform was not secured to the lifting carriage or to the forks to prevent it from sliding off the forklift. Among other methods, one feasible and acceptable method to correct this hazard would be to secure the platform to the carriage or to the forks.ge
