Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to potential injury from falling out of the bucket of a front end loader/backhoe: (a) North lane of fuel pump area under the canopy; an employee was observed being lifted in the bucket of the Ford 775 front-end loader to install/change lights under the canopy. * A feasible and useful means of abatement would be to instruct employees not to ride in any position of a heavy equipment vehicle except those designated for the operators or passengers.
