Section 5(a)(1) of the Occupational Safety and Health Act of 1970:
The employer did not furnish employment and a place of employment
which were free from recognized hazards that were causing or likely
to cause death or serious physical harm to employees in that
employees were exposed to multiple injuries from falling hazards when
employees are elevated on platforms when used with a powered industrial
truck and the platform is not secured to the lifting carriage and/or
forks and not provided with a midrail and a 4 inch toeboard:
a)   Maintenance Department - The two (2) personnel
platforms were not secured to the powered industrial
trucks lifting carriage and/or forks and did not have
a guardrail system that included a midrail and a 4
inch toeboard.
Among other methods, one feasible and acceptable abatement method to
correct this hazard is to secure the personnel platform to the lifting
carriage and/or forks and install a midrail and a 4 inch toeboard in the
guardrail system.
