Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not furnish
employment or a place of employment which was free from recognized hazards
that were
causing or likely to cause death or serious physical harm to employees in
that employees riding
the freight elevator were exposed to the hazard of fractures and/or
lacerations from getting body
parts, such as hands or feet, wedged between the elevator car and the back
wall of the elevator
shaft.
In the production area, the freight elevator car was not enclosed on all
sides. The back
wall of the elevator was only partially enclosed. The area from the floor
of the car to a
height of 4 feet was not enclosed.
One feasible method of abatement includes but is not limited to
completely enclosing the
elevator car as specified in Secton 204.1a of the American Society of
Mechanical
Engineers (ASME) standard 17.1-1993, Safety Code for Elevators and
Escalators.
