Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a)U.O.G.: Employee operated a SamSong Excavator MX-292, doing work at the pounding drainage. Nuts and bolts were modified and used as pins for the shovel and jack hammer, instead of the pins originally provided by the manufacturer to secure the shovel and jack hammer. AMOUNT OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE METHOD TO CORRECT THE HAZARD IS: 1.To follow the Association of Equipment Manufacturers (AEM) "Safety Manual for Operating and Maintenance Personnel" which requires that damaged and missing parts are repaired or replaced, and 2.To follow the Manufacturer's Operator Manual by using only service parts meeting manufacturer specifications, and 3.To train operators and maintenance personnel to inspect equipment for defects and to complete service and repairs before equipment is placed back in service. REPEAT VIOLATION: SEONG JIN CONSTRUCTION, INC. WAS PREVIOUSLY CITED FOR A VIOLATION OF THIS OCCUPATIONAL SAFETY AND HEALTH STANDARD WHICH WAS CONTAINED IN OSHA INSPECTION NUMBER 308578921, CITATION NUMBER 1, ITEM NUMBER 1, ISSUED ON 06/15/2005, WITH RESPECT TO A WORKPLACE LOCATED AT U.O.G., MANGILAO, GUAM 96923.
