Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a.San Jose Beach Road, Saipan: Personnel on a pallet were raised 12 feet in the air using the tines of a Toyota forklift. Hazards include a lack of fall protection, the platform was not adequately secured, the working platform did not contain a slip resistant floor surface, and its load capacity was unknown. Abatement Notes: Among other methods, one feasible and acceptable abatement method to correct this hazard is to ensure operators do not allow personnel to be elevated on a forklift that was not designed for this purpose as referenced in ASME B56.1-2000.
