Section 5(a)(1) of the Occupational Safety and Health Act of 1990: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a fall hazard from the bucket of a hydraulic excavator: a.ON THE JOBSITE, ROUTE 92, WEGMANS ROAD EXPANSION PROJECT, MILE MARKER 3308/3027: On or about July 15, 1994, employee exposed to a fall hazard while standing in the bucket of a Caterpillar hydraulic excavator, model #320. The employee was standing in the bucket trying to remove overhead traffic signs from the horizontal section of a traffic sign pole. One feasible and acceptable abatement method, among others, to correct this hazard is to: Utilize an elevating platform or lift with standard guardrails and safety belt with lanyard (if needed) to safely access the work area.
