Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: being struck by the elevated load (Steel Beam) while being loaded into the rear of a Euclid R-22 Rear Dump Truck. AMONG OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE ABATEMENT METHOD TO CORRECT THIS HAZARD IS: 1) Instruct employees in the proper techniques of lifting unstable objects as required by CATERPILLAR OPERATION AND MAINTENANCE MANUAL for 235D Excavators which states. Use the lifting hook on the back of the bucket to sling objects (page 50). 2) Follow the requirement of the CIMA SAFETY MANUAL FOR HYDRAULIC EXCAVATOR states. Items to be lifted by a hydraulic excavator are to be slung from the manufacturers designated lift point, Pg. 26 and not to drop elevated loads from unnecessary heights, Pg. 17.
