Section 5(a)(1) of the Occupational Safety and Health Act of 1970:

The employer did not furnish employment and a place of employment
which were free from recognized hazards that were causing or likely to
cause death or serious physical harm to employees in that employees
were exposed to the hazards of entering peroleuum storage tanks to
conduct visual inspections:
a- Crown Central Petroleum, Elizabeth Terminal - Employees were
required to enter petroleum storage tanks to conduct visual
inspections of the interior.  The tanks, which are constructed
of steel, range from 80 feet in diameter by 35 feet in height,
to 140 feet in diameter by 48 feet in height.  The access hatch
on all tanks is 24 inches indiameter.  The employer did not
ensure that procedures and equipment necessary to rescue
employees from the tanks were provided and implemented, to
include:
1- Adequate rescue equipment for both entrant and attendant.
(Safety harnesses and lines, respiratory protection for both
employees.)
2- Adequate training for both entrants and attendants in order
that employees clearly understanda their roles and
responsibilities.
3- Written rescue procedures defining the attendant's actions
in the event of an emergency.
Among other methods, one feasible and acceptable abatement
method to correct this hazard is to:
1- Provide rescue equipment for both the entrant and attendant;
to include safety harnesses and lines; and adequate respiratory
protection.
2- Ensure that employees entering the petroleym tanks and
attendants are properly trained.  Training should include, but
not be limited to:  communication procedures, use of rescue
and protective equipmetn and rescue procedures.
3- Develop written rescue procedures specifically defining the
attendant's actions in the event of an emergency.
