Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of being struck by misdirected projectiles from air powered nail guns: EMPLOYEES WORKING IN THE AREA WHERE PALLETS WERE BEING REASSEMBLED WITH NAIL GUNS, WERE NOT WEARING ADEQUATE PERSONAL PROTECTIVE EQUIPMENT SUCH AS BUT NOT LIMITED TO SAFETY GLASSES, FACE SHIELDS, HARD HATS, AND FLAK JACKETS OR OTHER APPROPRIATE GARMENTS. AMONG OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE ABATEMENT METHOD TO CORRECT THIS HAZARD IS, ISOLATION/SHIELDING OF EMPLOYEES AND A FORMAL HAZARD ASSESSMENT ALONG WITH ADEQUATE TRAINING RELATING TO SAFE NAIL GUN USAGE.NG
