Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: To the hazard of being crushed by the powered industrial truck in the event of a roll-over accident where he is ejected from the truck at the construction of building 191 at the North Little Rock Veterans' Affairs hospital. The operator of the Gradall rough terrain powered industrial truck was observed while operating the lift and traveling without the seat belt engaged. One feasible and acceptable abatement method to correct this hazard is to require the operator to wear his seat belt at all times when he is sitting in the seat of the lift, regardless of the length of time that he will be in the seat, as warned by the lift manufacturer in a warning posted on the frame of the lift.
